Service employees, repairmen, cable guys and yes, mailmen, have encountered the not-so-nice side of man’s best friend. Being bitten by a dog while on the job is quite common. In workers’ compensation Subrogation terms this is called strict liability. Strict liability is a condition that is inherently dangerous.
Homeowner’s policies have coverage for this type of liability. There is really no defense against a dog bite unless the person was uninvited on the premises. Most claims are simple and inexpensive. The homeowner’s policy usually recognizes this and pays the Subrogation lien. However, in recent years exclusions to the policy have named certain breeds of canine to be uninsurable. When Subrogation encounters this situation we pursue the homeowner directly. If the homeowner ignores our demands, judgment, liens and possible suspension of their driver’s license can follow.
